Bill Cosby is outside and he’s ready to get back to performing.

On the last day of June 2021, Pennsylvania’s highest court threw out Bill Cosby’s sexual assault conviction and he was released from the State Correctional Institution Phoenix in Montgomery County, Pennsylvania. He was released on a "procedural issue," not because he was found NOT guilty.

In a statement, District Attorney Kevin Steele said Cosby went free “on a procedural issue that is irrelevant to the facts of the crime.” He commended Constand for coming forward and added: “My hope is that this decision will not dampen the reporting of sexual assaults by victims.”

In April 2018, Bill Cosby was convicted of drugging and sexually assaulting Andrea Constand.

In September 2018, he was sentenced to three to ten years in prison, a term he was serving at a maximum security state facility in Pennsylvania.

Some folks were shocked while others were hype he got out, celebrating that "America’s Dad" was finally free.

The "Cosby Show" creator is just as excited. In fact, he’s “exuberant.” And he’s ready to get back to performing — and more.

“In his physical appearance, he’s exuberant. In his mental state, he’s exuberant. In his feelings and humor, he’s exuberant,” publicist Andrew Wyatt told The Los Angeles Times. The comedian is “colorful and powerful — more powerful than we’ve ever seen.”

The 83-year-old was reunited with his family after the three counts of aggravated indecent assault against Andrea Constand was overturned. But plans are in the works to get “The Cosby Show” star back onstage in the U.S., Canada and London, Wyatt said.

After his release, he released a statement via Twitter maintaing his innocence.

The embattled comedian blamed the media for his take down in a series of tweets:

Outside of the court drama, Bill claims he’s ready to get back to performing.

The LA Times reports:

Wyatt said Cosby’s next act will weave the disgraced comic’s “vintage storytelling” in with observations from his life today and will be “inclusive of human rights and civil rights” as Cosby works for criminal justice reform and prison reform based on his own experiences.

Cosby “gives you a formula without the preservatives,” his rep said.

Cosby’s team — including the legal staff — still has to work out the details about how audiences, promoters and “media insurrectionists … who fuel the hate” will be screened, Wyatt said, but he’s not very concerned about hecklers and the like. Plus, he said, “It’s not happening tomorrow.” They have time.

Yeah. Hecklers could def be a problem.

BREAKING: Bill Cosby To Be RELEASED From Prison, PA Supreme Court Overturns Sexual Assault Conviction

Embattled star Bill Cosby will be released from prison in a shocking development.  Details inside.

 

The Pennsylvania Supreme Court overturned Bill Cosby’s 2018 sexual assault conviction today (Wednesday, June 30th) after finding that testimony tainted the trial.  Cosby’s publicist, Andrew Wyatt (pictured below), will be picking him up to leave prison within hours, Wyatt confirmed to ABC News. The 83-year-old was originally sentenced to 3-10 years in state prison.

As for which testimony the court deemed to be the culprit, there are two points suspected.

Last year, the Pennsylvania Supreme Court agreed to hear two points in Cosby’s appeal to overturn his 2018 sexual assault conviction.

One was the admission into trial of "prior bad acts" witnesses and Cosby’s 2005-2006 quaalude deposition. The appeal argued that the trial judge erred in allowing Cosby’s prior deposition about using quaaludes during consensual sexual encounters with women in the 1970s at trial.

The second point was a written agreement from previous Montgomery County prosecutor Bruce Castor not to criminally prosecute Cosby in the Constand case. Castor had testified that while he was district attorney, he promised Cosby he would not file criminal charges if the entertainer would testify in a civil lawsuit Constand filed against Cosby in 2005. Cosby testified during four days of depositions by Constand’s attorneys, and the civil lawsuit was settled for more than $3 million in 2006. Prosecutor Kevin R. Steele later brought criminal charges against Cosby in 2015 after succeeding Castor as the county’s district attorney.

It’s a stunning turn of events after multiple appeal rejections and changes in Cosby’s legal representation over the last several years.  His most recent appeal was denied just last month.

Cosby was first charged for sexual assault in 2015Andrea Constand accused Bill Cosby of drugging and sexually assaulting her over a decade ago when she was worked for the Women’s Basketball team at Temple University (Bill’s alma mater and where he visits frequently).

Andrea was one of approximately 60 women accusing him of sexual misconduct, assault, and/or rape.  Cosby still maintains he never engaged in any non-consensual sexual acts.

Bill Cosby isn’t getting our of prison anytime soon.

The 83-year-old “Cosby” creator was denied parole after refusing to participate in state-mandated sex offender programs during his nearly three years behind bars. Cosby said he would serve the full 10-year sentence rather than acknowledge wrongdoing and take part in a therapy program for sexually violent predators.

This is the first year Cosby was eligible for parole since his guilty verdict was handed down. Cosby was sentenced to 3-10 years on September 25, 2018 after he was found guilty on three counts of aggravated indecent assault. Cosby was accused of drugging and sexually assaulting Andrea Constand at his Philadelphia home in 2004

Since his conviction, Cosby has been serving out his sentence at SCI-Phoenix in Montgomery County, Pa.

Laura Treaster, a spokeswoman for the state parole board, confirmed the decision, which was made on May 11.

Cosby spokesperson Andrew Wyatt called the decision “appalling” and said Cosby “vehemently proclaims his innocence.”

“We knew he was going to be rejected,” said Andrew Wyatt. “He called me and told me that if he didn’t take the course, he would be denied. He has maintained his innocence from the beginning.”

The troubled star must also overcome a recommendation against parole from the state Department of Corrections and maintain a clear conduct record. Cosby was also told to develop “parole release plan.”

In the meantime, Cosby is keeping hope alive that the Pennsylvania Supreme Court will rule in his favor after filing an appeal this past December. The court has not ruled yet.

Cosby’s lawyers argued the trial was flawed because five other accusers were allowed to testify to support the sexual assault complaint filed by a former Temple University basketball team manager. Not only that, they also said the judge should not have let the jury hear Cosby’s damaging testimony from accuser Andrea Constand’s related civil suit.
